Donald Trump suffers another blow after Judge Chutkan rejects his motion

Former US President Donald Trump pauses during an address at a campaign rally at Mohegan Sun Arena in Wilkes-Barre, Pennsylvania, US. — Reuters/File Former US President Donald Trump pauses during an address at a campaign rally at Mohegan Sun Arena in Wilkes-Barre, Pennsylvania, US. — Reuters/File

A plea by former US President Donald Trump was rejected Wednesday by Judge Tanya Chutkan asking her to recuse herself from overseeing the case of the Republican presidential forerunner concerning blocking the election results of 2020 and deliberations to remain in the Oval Office after suffering a defeat from Democrat Joe Biden.

“Recusal motions served a vital purpose, justice also demands that judges not recuse without cause,” wrote Judge Tanya Chutkan Wednesday.

She further stated pointing to a prior court decision, that recusal motions can be “a procedural weapon to harass opponents and delay proceedings.”

“Motions for recusal could also be wrongfully deployed as a form of ‘judge shopping,'” Chutkan wrote.

Weeks earlier, the four-time criminally indicted former president filed a motion through his lawyers maintaining that District Judge Tanya Chutkan should be removed from his case as her past statements show clear bias against the Republican forerunner.

“The defence interprets the court’s verbal reiteration of Palmer and Priola’s arguments about their relative culpability as ‘suggest[ing]’ a secret core view about Defendant’s criminality….That inferential leap is not reasonable in light of the relevant facts, record, and law,” the judge wrote.

“The court was legally bound to not only privately consider those arguments, but also to publicly assess them.”

Chutkan also noted she had never made any comments on Trump’s culpability — noting it was his own attorneys who leaped to that conclusion.

Judge Chutkan is to preside over the case regarding Trump’s involvement in subverting 2020 election results and the January 6, 2021, Capitol Hill riots.

Perkasie man charged with assault over skate park attack on teen

A 19-year-old Perkasie man is accused of stabbing a teenager at a skate park Monday afternoon.

Perkasie police responded to Grand View Hospital, where they met with the mother of a 15-year-old boy who was allegedly stabbed at the Lenape Skate Park on Constitutional Avenue, according to a probable cause statement.

The mother told police when she met her son at the park pavilion that she saw blood on his shirt. She was then approached by Nikolas Anthony Lore, who apologized to her.

A 19-year-old man was arrested Monday, September 25, 2023, and charged with stabbing a 15-year-old at a Perkasie skate park.

Update on the injured bald eagle Injured bald eagle found in Bensalem now has a diagnosis. And we know where she came from

The woman immediately took her son to the hospital where he was treated for non-life-threatening injuries, police said.

The victim alleged that while at the park, Lore retrieved a 10- to 12-inch knife from his car and began walking toward him with the knife in a sheath, police said. The victim ran away, but felt something hit his back twice. He ran into a bathroom where he noticed two cuts about four inches long on his upper back.

Medical personnel told police the wounds would require stitches, the affidavit said.

Police returned to the skate park where they found Lore, who had been taken into custody. The knife allegedly used in the attack has also been seized, police said.

The charging documents provide no details about what led to the alleged attack.

Lore was indicted on charges including aggravated assault with a deadly weapon and related charges. He is being held at the Bucks County Correctional Center in lieu of 10% bail on $150,000.

Great Barrington — Alliance for a Viable Future (AVF) and the Mahaiwe Performing Arts Center will present the second annual “Honoring Native America” event on Friday, October 6, to kick off Indigenous Peoples’ Day weekend in the Berkshires. Friday’s program consists of flute music performed by R. Carlos Nakai; stories from Mohican storyteller Shawn Stevens; and a talk by lawyer and peacemaker Cheryl Fairbanks, Esq. Executive Director of Alliance for a Viable Future Lev Natan will deliver opening remarks. The Mahaiwe describes the event as going “beyond performance into the interactive realm of ceremony and collective prayer.”

Born in 1946, R. Carlos Nakai is a Navajo and Ute flutist. He initially played brass instruments but switched to the Native American cedar flute due to an injury. Self-taught, Nakai released “Changes” in 1983 and signed with Canyon Records, producing over 37 discs for that label. His music blends traditional Native American melodies with original compositions. Nakai has collaborated with such musicians as composer Philip Glass, flutist Paul Horn, guitarist/luthier William Eaton, composer James DeMars, two-time-Grammy-winning producer Billy Williams, and a very long list of others. Nakai has received 11 Grammy nominations.

Although an ordained minister of the Universal Church of Light, Shawn Stevens does not answer to “shaman” or “medicine man.” Instead, he calls himself a helper. He is also a drummer, dancer, singer, flutist, historian, and especially a storyteller. Shawn is a member of the Stockbridge-Munsee Band of Mohicans, but his…

State police charge boy, 16, with attempted homicide in Nanticoke drive-by shooting

WILKES-BARRE — State police at Wilkes-Barre charged a 16-year-old Wilkes-Barre boy as an adult with the attempted homicide of a 14-year-old boy in a drive-by shooting in Nanticoke in July.

James Alberto, address unknown, was taken before Luzerne County Judge Joseph F. Sklarosky Jr. where he was arraigned Thursday.

Investigators allege Alberto was the gunman when he leaned out a passenger window of a 2014 Hyundai Elantra and fired multiple shots, striking the 14-year-old in the head and ankle in the area of West Green and Maple streets on July 21.

The Hyundai, allegedly driven by John Carl Pearce IV, 16, of Wyoming, was reported stolen to Nanticoke City Police on July 19.

Pearce was initially identified as the shooter in a criminal complaint when he was arrested by state police July 26.

State police withdrew the criminal complaint against Pearce on Wednesday, refiling an amended complaint that identifies Pearce as the driver and Alberto as the alleged gunman.

Investigators believe the 14-year-old boy was targeted in retaliation as Alberto believed he made disrespectful comments about a deceased infant, according to the criminal complaint filed against Alberto on Thursday.

According to the criminal complaint:

A woman from Nanticoke reported her Hyundai Elantra stolen from her residence on July 19. Two day later, July 21, Nanticoke City police responded to gunfire at West Green and Maple streets where they found the 14-year-old boy with gunshot wounds to his head and ankle.

Surveillance footage in the area showed the 14-year-old boy walking as the Hyundai was recorded driving slowly with the rear passenger wearing a ski mask lean out the window and discharged rounds across the roof of the vehicle, the complaint says.

After the shooting, the occupants of the Hyundai were recorded…
