Chief public defender replaced in defending Nanticoke man on fatal drug driving charges

WILKES-BARRE — A Nanticoke man charged in the drug driving death of James Mahon in Plymouth last year was appointed a new defense attorney Tuesday due to a breakdown in the attorney-client relationship with his previous lawyer, Luzerne County Chief Public Defender Steven M. Greenwald.

Jose Calo, 58, of Pine Street, was under the influence of fentanyl when he crashed his Ford Explorer that killed Mahon, 86, in the area of 10 E. Main St. on June 25, according to court records.

Greenwald graduated in 1977 from Wyoming Valley West High School when Mahon was an assistant principal.

Calo when presented with a plea agreement offered by the District Attorney’s Office in March began to express his disappointment that Greenwald had a prior “relationship” with Mahon, according to court records.

Greenwald said he had no relationship with Mahon other than the fact Mahon was an assistant principal at the high school he attended. Greenwald said he had not spoken with Mahon in nearly 45 years.

Despite the near half century of not seeing or speaking with Mahon, Calo felt there was a conflict with Greenwald defending him on charges of homicide by vehicle, homicide by vehicle while driving under a controlled substance, accidents involving death, driving under a controlled substance, driving with a suspended license and several traffic violations.

Since March, Calo refused to meet with Greenwald and members of the public defender’s office at the county correctional facility.

Greenwald filed a motion for a conflict attorney to be appointed to represent Calo.

In court Tuesday, President Judge Michael T. Vough said defendants have a right to be represented by an attorney but don’t have the right to chose an attorney if they are unable to afford one themselves.

Local roundup: Wyoming Area softball scores five in 7th to earn walk-off win

Down by four runs heading into the bottom of the seventh, Wyoming Area softball rallied for five runs in the final frame to earn a walk-off 6-5 win over Dunmore on Saturday in a non-conference matchup.

Alexa Gasek shined for the Warriors, finishing with a home run and four RBI at the plate while going the distance in the circle for the win, striking out six and allowing one earned run on three hits.

Gasek, Anna Wisnewski and Kayla Leo all finished with two hits apiece for the Warriors, who trailed 4-0 after the top of the first and 5-1 after six.

Elk Lake 12, Nanticoke Area 1

Elk Lake had seven extra-base hits as the Warriors won in five innings.

Megan Johns led Elk Lake with a home run and four RBI.

Mckenzie Stratton had Nanticoke Area’s only RBI.

Tunkhannock 13, Parkland 1

Sydney Huff was 4-for-4 with a triple, double and six RBI as Tunkhannock defeated host Parkland in five innings.

Paige Marabell and Erin Van Ness were each 3-for-3 with two RBI. Marabell also had a double. McKenzie Hannon doubled and had two RBI.

BASEBALL

Crestwood 3, Nanticoke Area 1

Ben Keil struck out nine and Chaz Wright was 4-for-4 as Crestwood won a non-league game.

Wright, Joe Moritori and Evyn Makowski each had an RBI for the Comets. Keil allowed four hits over six innings. Robert Duffy threw the final inning to get the save.

Brandon Wozniak doubled and Jay Shemanski singled and had an RBI for Nanticoke Area.

Dunmore 6, Wyoming Area 3

Wyoming Area jumped an early lead on Jack Mathis’ three-run homer in the first inning, but Dunmore rallied for the non-conference victory.

Sen. Baker, Rep. Ryncavage open new offices in Nanticoke

Apr. 21—NANTICOKE — Sen. Lisa Baker on Thursday said a crucial part of public service is meeting face-to-face with constituents, listening to what they have to say and alerting them to state programs and services that may assist in improving their personal situation.

Baker, R-Lehman Township, Rep. Alec Ryncavage, R-Plymouth, announced they will host a joint open house at their district offices on Friday, April 28, from noon to 4 p.m., at 50 North Walnut St., Suites 105 (Baker) and 102 (Ryncavage), in Nanticoke.

The lawmakers are opening offices in a new downtown building at 50 N. Walnut St., constructed for Nockley Family Pharmacy and Cawley Physical Therapy and Rehab.

“For people who want to talk about issues, this joint open house allows them to gain perspective from both the Senate and state House,” Baker said. “We receive input and information from a wide variety of sources, but community conversation still gives the most helpful insight.”

Ryncavage said that as a new legislator he is grateful that he and a seasoned senator like Baker will be in close proximity to one another as they help their constituents.

“Our neighboring offices create a one-stop shop for our residents,” Ryncavage said. “The building and ample off-street parking make our space accessible, welcoming and convenient for those needing legislative services.”

The offices of Baker and Ryncavage can assist residents with PennDOT paperwork, driver’s license and vehicle registration applications and renewals; information and applications for senior citizen benefit programs, including Property Tax/Rent Rebate and PACE/PACENET prescription drug programs; securing birth and death certificates (photo identification required); organizing tours of the state Capitol; copies of legislation; and many other services.
